Content: All services provided by Absolute Web Hosting may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any law in the USA, Canada, New Zealand, Australia and the UK is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secrets and other statutes. Absolute Web Hosting is not responsible for any claims resulting from the use of our service. This is also true for sites that promote any illegal activity or content that may be damaging to the servers of Absolute Web Hosting or any other server on the internet. Links to such materials are prohibited. This includes, but is not limited to illegal adult sites, warez/pirated software, serialz, hacker programs/archives, and illegal MP3 files.

SPAM, UCE, Safe-Lists, MLM: Spamming, or the sending of unsolicited email, from a server of Absolute Web Hosting or using an email address that is maintained by Absolute Web Hosting is STRICTLY prohibited and will qualify your site for immediate deactivation with no refund. Absolute Web Hosting will be the sole arbiter as to what constitutes a violation of this provision. Additionally claims investigated by Absolute Web Hosting about spam from any of our users or users of theirs, will be fined and billed for such work. Absolute Web Hosting will not host sites/services that promote or use "safe-lists", "opt-in special offers mailing lists", "target-lists", or any offer service that falsely tries to disguise their mailings as non-intrusive.

Add-on Domains, Subdomains and Parked Domains: Reselling of add-on domains or subdomains under your standard web hosting account is strictly prohibited; you are solely responsible for all add-on domains, subdomains and parked domains under your account. Use of any software or technique to run multiple websites using parked domains or subdomains is also not allowed.

Adult: Web sites containing "adult" content of any-sort or that link to other sites containing "adult" content are strictly prohibited. Absolute Web Hosting will be the sole arbiter as to what constitutes a violation of this provision.

Free Services: No services provided by Absolute Web Hosting may be used to provide free resources, this includes, but is not limited to e-mail addresses, web space, e-mail or domain redirecting, DNS, shopping carts and remote script hosting. This does not prevent users from using external services such as Everyone.net and BigMailBox or any other third-party hosted solution that provide free resources to visitors.

Background Running Programs: We may allow programs to run continually in the background. However, these are considered on a one to one basis and an extra charge may be incurred based on system resources used and operational maintenance needed. Port forwarders are NOT allowed under any circumstances.

IRC: We currently DO NOT allow IRC, IRC bouncers, IRC bots, egg drops, or similar software to be operated on our servers.

Accessing Other Systems: We do not allow illegal or unauthorized access to other computers or networks belonging to another party, or attempts to penetrate security measures of another individual's system (often known as "hacking"). We also do not allow any activity that might be used as a precursor to an attempted system penetration (i.e. port scan, stealth scan, or other information gathering activity). Shell activity and su attempts are recorded.

Server Abuse: Any attempts to undermine or cause harm to any server of Absolute Web Hosting or any customer of Absolute Web Hosting is strictly prohibited. Absolute Web Hosting holds no responsibility for the use of our clients' accounts. Any account the abuses resources and actions are not taken to desist, calls for immediate de-activation without any refund of payments made thus far. Any site using what we deem to be using excessive CPU cycles or any resources that cause strain to other sites may also be offered new terms.

Data Transfer: Each account is allocated a pre-specified amount of data transfer (also known as bandwidth) per calendar month. Sites are not restricted to a traffic rate, if your account's monthly usage is above your monthly total allotment you will be charged for the additional bandwidth on your next monthly bill. Optionally you can e-mail us to cap your site at your bandwidth limit, or you may choose to either upgrade to a higher package or contact us regarding dedicated services. We will work with clients to keep their sites alive and fast at all times.

Backups: Absolute Web Hosting performs periodic backups of critical system files for emergency purposes. Clients should not rely on Absolute Web Hosting to perform site/data backups for them and are responsible for backing up their own data. An easy-to-use instant backup facility is available via the client's online control panel. MySQL data dumps can be easily performed by the client via the included phpMyAdmin or Telnet/SSH. Clients are advised to backup all of their own files to their local drives. Absolute Web Hosting is NOT responsible for lost data, time, income or any other resource due to hardware failure, faulty backups or non-existent backups.

Billing: The first payment is due on the signup date. Subsequent payments are due every month following this date (for monthly billing cycles), or every 365 days following this date (for annual billing cycles). Accounts 15 days past due will be de-activated. Accounts 30 days past due will be deleted from the server without a refund of any payments made thus far. If any terms or conditions fail to be followed the account in question will be automatically deactivated. You will be billed by Genamics Ltd, this is also the name that will appear on your credit card statement, please make a note of this to avoid confusion at a later date. You are also giving us permission to register your domain name for you when selecting "new domain" in the order form of our site. Any chargebacks will be dealt with very seriously, we reserve the right to forward any owed debts (e.g. resulting from a chargeback) to our debt collection agency, whom will add their fee and interest to the total, this may also affect your credit rating.

Cancellation: Cancellation can be made via email to sales@buywebhosting.co.nz. Although no notice is required, and there is no cancellation fee, all fees paid for service up to the notice of cancellation are non-refundable. If cancellation is made within the first 30 days of service and no terms are breached all hosting fees will be refunded. This does not include fees for domain registration. We reserve the right to remove any account without prior notice for any reason. In this unlikely event, we will refund all unused pre-paid months of hosting services. However, if your account is cancelled for violation of these terms and conditions you will not be entitled to a refund.

Refusal of Service: We reserve the right to refuse, cancel, or suspend service at our sole discretion.

IN NO EVENT WILL ABSOLUTE WEB HOSTING BE LIABLE FOR ANY DAMAGES, INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF THE USE OF OR INABILITY TO USE ABSOLUTE WEB HOSTING'S SERVICES OR ANY CONTENT THEREON. THIS DISCLAIMER APPLIES, WITHOUT LIMITATION, TO ANY DAMAGES OR INJURY, WHETHER FOR BREACH OF CONTRACT, TORT, OR OTHERWISE, CAUSED BY ANY FAILURE OF PERFORMANCE; ERROR; OMISSION; INTERRUPTION; DELETION; DEFECT; DELAY IN OPERATION OR TRANSMISSION; COMPUTER VIRUS; FILE CORRUPTION; COMMUNICATION-LINE FAILURE; NETWORK OR SYSTEM OUTAGE; OR THEFT, DESTRUCTION, UNAUTHORIZED ACCESS TO, ALTERATION OF, OR USE OF ANY RECORD.
